1. Introductory Provisions and Definition of Terms
Online services of Cothema s.r.o. are publicly accessible via website at cothema.com, or other addresses, hereinafter referred to as Online services.Online services also include e-shop, API interfaces and source codes, hereinafter referred to as Components of online services.
The operator of Online services is: Cothema s.r.o. (ID: 03255336), náměstí 14. října 1307/2, Smíchov, 150 00 Prague (hereinafter referred to as Provider).
Anyone who directly or indirectly (for example, using automated scripts) uses Online services in any form is considered a customer, hereinafter referred to as Customer.
Unless expressly stated otherwise, Terms of use apply not only to Online services, but also to Components of online services.
The provisions set out in these Terms of use (hereinafter referred to as Terms) are defined primarily to preventively avoid potential disputes in the future and to meet legislative and contractual conditions of suppliers.
All provisions of Terms are valid for both paying customers and other website visitors (unless expressly stated otherwise).
2. Terms of Use
By using Online services, Customer agrees to these Terms without reservation. If Customer does not agree with Terms, they must immediately stop using Online services.
Customer uses Online services fully at their own responsibility and with awareness of risks that may threaten them.
Unless otherwise agreed, Provider does not provide any warranties or compensation (for example, for loss of data, inaccuracy of information provided or non-functionality of Online services).
Customer waives the right to claim compensation for damage, lost profit, and other compensation that may arise in connection with the use of Online services.
By providing their data, Customer grants Provider the right to further use them for specified purposes.
If data from Online services are provided by customer to third parties,Customer undertakes to ensure compliance with license conditions for such data and assumes responsibility for their provision and handling.
3. Purchase via E-shop
3.1. Payment Terms
Payment for ordered services is possible via the payment selection page, to which the customer is referred during the order process.
Payment method is possible using payment methods listed on the payment selection page, in one of the following ways: bank transfer, online payment card.
Payment must be made no later than the due date of the order, but no later than on the day of course start (unless otherwise agreed in writing).

The provider of the payment gateway for "Online payment" method is Comgate, a.s. The service provider, Comgate a.s., is a licensed Payment Institution operating under the supervision of the Czech National Bank. 3.2. Delivery Terms
Customer places and pays for their order through the e-shop, which is subject to these terms.
The order is considered closed at the moment of complete payment by the customer.
Customer will receive necessary information to use the purchased service within 3 business days from order closure.
3.3. Complaint Procedure
Complaint procedure applies to services purchased within the online store, which is subject to these Terms
Complaints relate to defects in delivered services compared to the service description that the operator at the time of purchase stated on their e-shop.
Customer has the right to file a complaint if the delivered services exhibit these defects.
Complaint must contain: Customer's first and last name, company name (in case of corporate purchase), contact phone and email, order number and specific description of the defect or deficiency that will be submitted for assessment.
Complaint can be filed after complete delivery of ordered services or expiration of the delivery period for these services, but no later than 2 years from delivery.
Upon receipt of complaint, customer will receive confirmation of complaint receipt.
Complaint will be resolved within 30 days from its filing. If the complaint is not resolved within 30 days from proven delivery to the operator, customer has the right to request a refund.
4. Personal Data Protection
The controller of personal data is Operator.
All personal data are stored and processed especially for the purpose of identifying Customer for use of personalized services and for other purposes related to the use of Application.
Personal data may be stored on third-party servers for operational purposes.
Personal data will not be provided without explicit consent of Customerto other third parties for purposes other than operational.
Customer has the right at any time to request Provider to delete their personal data at the stated contact email. Provider will comply with the request within the period necessary to process the request.

5. Final Provisions
Business terms are governed by the legal system of the Czech Republic.
If some provisions cannot be considered valid, then the remaining provisions remain valid without changes.
Provider reserves the right to change Terms at any time upon their publication on the website.
